By accessing or using Stay71.com, creating an account, making a booking, or listing a property, you confirm that you have read, understood, and agree to be bound by these Terms & Conditions and all applicable UAE laws and regulations. If you do not agree, you must not use this platform.

1. About Stay71

Stay71 (operated by Al Wafaa Group / Daidu.ai, hereinafter "Stay71", "we", "us", or "our") is an online marketplace and technology platform that connects individuals seeking monthly hotel accommodation ("Tenants") with hotel operators and hotel apartment providers ("Hotel Partners") across the United Arab Emirates. Stay71 acts solely as an intermediary technology platform. We are not a hotel operator, property manager, landlord, letting agent, or real estate broker. We do not own, manage, control, or operate any of the properties listed on this platform. Our role is limited to: (a) providing the technology platform; (b) facilitating introductions between Tenants and Hotel Partners; (c) processing payments on behalf of Hotel Partners; and (d) providing customer support to both parties.

2. Platform Nature & Limitations

2.1 Stay71 is a portal service only. We provide a technology platform to facilitate bookings between Tenants and Hotel Partners. We are not a party to any agreement between a Tenant and a Hotel Partner. 2.2 Stay71 is not responsible for, and expressly disclaims all liability in respect of: any dispute between a Tenant and a Hotel Partner; any price changes, amendments, or cancellations made by Hotel Partners; the accuracy or completeness of information provided by Hotel Partners; the quality, safety, suitability, or legality of any property listed on the platform; any damages, losses, or injuries arising from a Tenant's stay; any services or amenities described but not provided by a Hotel Partner; or any changes in hotel policies, house rules, or operating procedures. 2.3 All disputes arising from a booking must be resolved directly between the Tenant and the Hotel Partner. Stay71 may, at its discretion, provide mediation assistance but is not obligated to do so and cannot be held liable for the outcome of any dispute. 2.4 Hotel Partners are independent businesses. They set their own prices, house rules, cancellation policies, and occupancy terms. Stay71 has no control over these and cannot guarantee their accuracy at any given time.

3. User Accounts & Eligibility

3.1 You must be at least 18 years of age to create an account or make a booking on Stay71. 3.2 You agree to provide accurate, current, and complete information when creating your account and to update this information as necessary. 3.3 You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. 3.4 Stay71 reserves the right to suspend or terminate any account that violates these Terms, provides false information, or engages in fraudulent activity. 3.5 By registering as a Hotel Partner, you confirm that you have the legal right and all necessary licences, permits, and approvals required under UAE law and the regulations of the relevant emirate's Department of Tourism and Commerce Marketing (DTCM) or equivalent authority to operate and list your property.

4. Bookings & Reservations

4.1 A booking constitutes a direct contract between the Tenant and the Hotel Partner. Stay71 facilitates this transaction but is not a party to it. 4.2 All bookings are subject to availability and confirmation by the Hotel Partner. 4.3 Tenants are responsible for verifying all details of their booking, including check-in/check-out dates, room type, number of guests, price, and included amenities, before confirming. 4.4 Hotel Partners reserve the right to decline a booking at their discretion, provided they comply with applicable UAE non-discrimination laws. 4.5 Stay71 may issue a booking reference number ("Stay71 Receipt") for administrative purposes. This receipt is not a tenancy agreement, lease contract, or legally binding occupancy document. It is an acknowledgement of a booking request only. 4.6 For the avoidance of doubt, Stay71 does not issue, guarantee, or take responsibility for any tenancy letters, occupancy certificates, or official documents. Any such documents issued are the sole responsibility of the Hotel Partner.

5. Pricing & Payments

5.1 All prices displayed on Stay71 are in UAE Dirhams (AED) and are set by Hotel Partners. Stay71 does not set, control, or guarantee the accuracy of listed prices. 5.2 Hotel Partners may change their prices at any time. The price confirmed at the time of booking is binding for that specific booking only. 5.3 Stay71 charges Hotel Partners a platform commission of 15% on each confirmed booking. This commission is deducted from the booking amount collected. Tenants do not pay any additional fees to Stay71. 5.4 Payment processing is handled by third-party payment providers (including Stripe). By making a payment, you agree to the terms of the relevant payment processor. 5.5 Stay71 is not responsible for any currency conversion fees, bank charges, or additional costs imposed by your financial institution. 5.6 In the event of a pricing error on the platform, Stay71 reserves the right to cancel the booking and issue a full refund. We will notify affected users promptly.

6. Cancellations & Refunds

6.1 Cancellation policies are set by individual Hotel Partners and may vary. The applicable cancellation policy will be displayed at the time of booking. 6.2 The standard Stay71 cancellation policy requires 15 days' written notice prior to the check-in date for a full refund. Cancellations made less than 15 days before check-in may be subject to a cancellation fee as determined by the Hotel Partner. 6.3 Refunds, where applicable, will be processed within 7โ€“14 working days to the original payment method. 6.4 Stay71 does not guarantee refunds for no-shows, early check-outs, or cancellations that do not meet the Hotel Partner's cancellation policy. 6.5 In the event that a Hotel Partner cancels a confirmed booking, Stay71 will endeavour to assist the Tenant in finding alternative accommodation but cannot guarantee availability or equivalent pricing. 6.6 Force majeure events (including but not limited to government travel restrictions, natural disasters, or public health emergencies) may affect refund eligibility. Stay71 will handle such cases on a case-by-case basis in accordance with UAE law.

7. Hotel Partners โ€” Obligations

7.1 Hotel Partners must ensure that all information provided on their Stay71 listing is accurate, current, and not misleading. 7.2 Hotel Partners are solely responsible for: compliance with all applicable UAE federal and emirate-level laws and regulations, including those of the relevant DTCM or equivalent licensing authority; maintaining all required licences, permits, and operating approvals; ensuring the health, safety, and wellbeing of guests; providing the amenities, services, and room types as described in their listing; and handling all guest relations, complaints, and disputes directly. 7.3 Hotel Partners must not solicit direct bookings from Tenants introduced through Stay71 for a period of 12 months following the initial introduction, in order to protect the integrity of the platform. 7.4 Hotel Partners agree to honour all confirmed bookings made through Stay71 and to provide the Stay71 commission as agreed. 7.5 Stay71 reserves the right to remove any listing that violates these Terms, receives consistent negative feedback, or is found to be operating without the required legal approvals.

8. Regulatory Compliance

8.1 All hotel and hotel apartment properties listed on Stay71 operate under the authority of their respective emirate's Department of Tourism and Commerce Marketing (DTCM), Department of Economy and Tourism, or equivalent regulatory body. Stay71 has no authority over, and takes no responsibility for, the regulatory compliance of listed properties. 8.2 It is the sole responsibility of Hotel Partners to obtain and maintain all licences, permits, and approvals required to legally operate their property and to accept guests. 8.3 Tenants acknowledge that the terms of their occupancy, including any tenancy documentation, are governed by the Hotel Partner's licence category and the applicable emirate's regulations โ€” not by Stay71. 8.4 The hospitality and short-term rental sector in the UAE is regulated at the emirate level. Rules and requirements differ between Dubai, Abu Dhabi, Sharjah, and other emirates. Stay71 makes no representations as to the regulatory status of any property and is not responsible for any regulatory changes that affect listings or bookings.

9. Intellectual Property

9.1 All content on Stay71, including but not limited to text, graphics, logos, images, software, and the Stay71 brand, is the intellectual property of Al Wafaa Group / Daidu.ai and is protected by UAE and international intellectual property laws. 9.2 You may not reproduce, distribute, modify, or create derivative works from any Stay71 content without our prior written consent. 9.3 By uploading content to Stay71 (including photos, descriptions, or reviews), you grant Stay71 a non-exclusive, royalty-free, worldwide licence to use, display, and distribute that content on the platform.

10. Limitation of Liability

10.1 To the maximum extent permitted by applicable UAE law, Stay71 shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to: loss of revenue, loss of profits, loss of data, loss of goodwill, or any damages arising from your use of or inability to use the platform. 10.2 Stay71's total liability to you for any claim arising out of or in connection with these Terms or your use of the platform shall not exceed the commission amount received by Stay71 in respect of the specific booking giving rise to the claim. 10.3 Stay71 does not warrant that the platform will be uninterrupted, error-free, or free from viruses or other harmful components. 10.4 Nothing in these Terms limits or excludes liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be limited or excluded under UAE law.

11. Governing Law & Dispute Resolution

11.1 These Terms and Conditions are governed by and construed in accordance with the laws of the United Arab Emirates, specifically the federal laws applicable in the emirate of Dubai. 11.2 Any dispute, controversy, or claim arising out of or relating to these Terms, or the breach, termination, or invalidity thereof, shall first be subject to good-faith negotiation between the parties. 11.3 If the dispute cannot be resolved through negotiation within 30 days, it shall be referred to the competent courts of Dubai, UAE, which shall have exclusive jurisdiction. 11.4 Nothing in this clause prevents either party from seeking urgent injunctive or other equitable relief from any competent court.

12. Changes to These Terms

12.1 Stay71 reserves the right to update or modify these Terms at any time. We will notify registered users of material changes via email or platform notification. 12.2 Your continued use of the platform following any changes constitutes your acceptance of the revised Terms. 12.3 If you do not agree to the revised Terms, you must stop using the platform and may request account deletion by contacting us at legal@stay71.com.
